Please read these Terms and Conditions (the “Terms”) carefully. The Terms set out below apply to all participants entering the Engen QuickShop ‘Ditch the Cold Catch the Cool’ Competition (“the Competition”) conducted by Engen Petroleum Limited, ("the Promoter"). If you do not agree to be bound by any or all of these Terms, please refrain from entering the Competition. Instructions on how to enter into the Competition, and all prizes, form part of the Terms. Participation in the Competition is deemed acceptance of the Terms.
Entries not complying with any of the Terms will be invalid and be of no force and effect.
The Competition is open to all persons over the age of eighteen (18) years residing in the Republic of South Africa, except directors, members, business partners, employees of the Promoter or its sales agents, advertising agencies staff, advisors, consultants, associated companies, service providers and the immediate family members of aforesaid persons (including, but not limited to, spouse, life partners, parents, children, brothers and sisters). The Competition also excludes the Promoter’s service station operators, staff and their immediate families.
To be eligible to win the prize of a Volkswagen Polo Vivo 1.4 Trendline Manual motor vehicle, entrants must also be in possession of a valid, unencumbered South African Driver’s License.
The Competition will commence on 00:01am 01 May 2019 and will end on 30 June 2019 at 23:59pm. Any entries received outside of the official Competition duration will be deemed invalid, and will be disqualified automatically.
Entry Mechanism: In order to enter the Competition, the customer must purchase a qualifying combo from the Promoter’s participating QuickShops nationwide and provide the cashiers with their cellphone number. Kindly retain receipt as proof of purchase. The qualifying combos include:

5.1 A total of four (4) Volkswagen Polo Vivo 1.4 Trendline Manual motor vehicles can be won. The prize is offered inclusive of all ‘on the road’ costs such as vehicle licensing and registration, but specifically excludes any additional costs such as insurance, maintenance, servicing etc. The colour of the vehicles is at the discretion of the Promoter.
5.2 Draws will be held fortnightly for the duration of the promotion. A total of 4 daws will be held according to the schedule below. One winner will be drawn at each draw. Entries are only valid for the draw period in which they occur. Winners will be drawn within twenty one (21) days of entering. All prize draws will be monitored, verified and certified by the Promoter’s auditors. The draw schedule is as follows:
Draw #1: entries from 1 – 15 May 2019
Draw #2: entries from 16 – 31 May 2019
Draw #3: entries from 1 – 15 June 2019
Draw #4: entries from 16 – 30 June 2019
5.3 No winner is allowed to win more than one prize and will be automatically eliminated once drawn.
6.1 Winners will be contacted telephonically on the cellphone number used to enter the Competition, within one week after the relevant draw has taken place. Winners who are not contactable on the cellphone number used to enter the Competition within five (5) days of the draw having taken place will result in the winner forfeiting the prize and the prize being awarded to a runner up.
6.2 Winners who are successfully contacted telephonically will then be sent an SMS containing a link to a microsite. Winners will be required to complete a form on the microsite. The form also requires winners to upload a copy of their ID Document, proof of address and valid South African Driver’s License. Failure to complete the form, or submit the required documentation, within seven (7) days, will result in the winner forfeiting the prize and the prize being awarded to a runner up. The winner will also need to present the originals of these documents as part of the vehicle licensing and registration process.
6.3 Delivery of the prize will be arranged at the Engen dealership where the entry was submitted within thirty (30) days of the winner being successfully verified.
The Promoter accepts no responsibility for any tax commitments arising from the acceptance of a prize and independent financial advice should be sought for such purpose.
The prizes are not transferable. No substitution or assignment of the prize is permitted. Prizes will under no circumstances be handed over to a third party and will only be transferred directly to the verified prize winner.
All entrants, by taking part in this Competition, indemnify the Promoter, its directors, employees, contractors, advertising agencies, advisors, suppliers and agents against any and all claims arising from the use of the prize, including, but not limited to: accident, injury, harm or loss.
The Promoter’s decisions on all issues regarding this Competition will be final and binding and no correspondence will be entered into.
Winners names will be published on the Promoter’s website: www.engen.co.za, should winners opt not to have their names published then only an initial and surname will be published so as not to make the winner identifiable.
By entering this Competition, you authorise the Promoter to collect, store and use (not share) your personal information for communication or statistical purposes. You are entitled to decline any marketing communication. Information will be retained for thirty (30) days beyond the closing date of the competition in order to satisfy the requirements of drawing, and validating, the required number of winners.
Winners may be required to take part in publicity campaigns for broadcasting or publishing purposes. Winners or participants shall at all times be entitled to decline the above request. Winners or participants who take part in any publicity will not be entitled to any payment or other remuneration for such publicity.
The Promoters may require the winners to complete and submit an information disclosure agreement and indemnification to enable the Promoters to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the Giveaway and it shall revert back to the Promoters.
The Promoters are not liable for any technical failure that may result in the Competition entry not being successfully submitted. Any give away, Prize or free item is accepted by any winner at his/her own risk. All publicity and other materials will be the sole property of the Promoter.
The Promoter and their promotional and advertising agents, merchandisers and organisers shall not be responsible for any subsequent decline of acceptance of prizes for any reason. This Promotional Competition is organized by ENGEN and their designated agency PESSO Marketing (collectively “the Promoters”) or “Organizers”.
The Promotional Competition period is from 1st May -12th May 2019 both days inclusive (“Period”).

Subject to the provisions of the Consumer Protection Act 68 of 2008, the Prize winner accepts the Prize at his/her own risk and the Promoters will not be liable for any costs incurred by the winner in claiming their prize. The Promoters cannot be held responsible for any accident, injury, or loss of property experienced as a result of winning, accepting and/or utilizing prizes won.
The Promoters may in their sole discretion amend these rules at any time, without notice, and such amendment(s) shall be deemed to have taken effect from the date of publication of the revised terms and conditions on the http://www.engen.co.za site.
Participants are only eligible to win 1 (one) prize in the competition. This competition is open to South African residents only and participants must be in possession of a valid identity document and participants must be aged 18 (eighteen) years or over.
By entering the Promotional Competition, all participants and winners agree to be bound by these rules which will be interpreted by the Promoters, whose decision regarding any dispute will be final and binding. The Promoters reserve the right to amend, modify, change, postpone, suspend or cancel this Promotional Competition and any prize (which have not yet been awarded), or any aspect thereof, without notice at any time, for any reason which the Promoters reasonably deem necessary.
Entries which are duplicated, unclear, illegible, are submitted via an incorrect entry mechanism or contain errors or are from Disqualified Persons will be declared invalid. Any technical failures that leads to any Promotional Competition entry being invalid or not received will not be the Promoters’ liability, and the Promoters cannot be held responsible for technical errors.
Selection of winners will be done on the 20th May where a random of 10 (ten) correct entries will be selected and verified. Winners will be contacted telephonically on the number that was entered into the competition. Prizes will be delivered to winners by appointed courier, which will be arranged by the Promoters within 3 weeks after contacting the winners.
If the Promoters are unable to reach any person after 1 (one) week or complete the verification process after drawing his/her entry for whatsoever reason, such person will be disqualified, and the draw of a replacement entry shall take place.
The Promoter shall have the right to terminate the Promotional Competition immediately and without notice for any reason beyond its control requiring this. In the event of such termination, all participants agree to waive any rights that they may have in terms of this Promotional Competition and acknowledge that they will have no recourse against the Promoters. Any dispute arises in relation to the interpretation of these Promotional Competition rules, the Promoters’ decision shall be final and binding and no correspondence shall be entered into.
All participants and the winners, as the case may be, indemnify the Promoters, their advertising agencies, advisers, nominated agents, suppliers and Bottlers of beverages identified by the trademarks and its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Promotional Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or use of the Prizes).
The Promoters may collect, store and use (but not share) any personal information of entrants for communication or statistical purposes. The duration of the Promotional Competition may also be extended or curtailed at the sole discretion of the Promoters. The Promoters may require the winners to be identified, photographed and the photographs published in social media, printed media, or to appear on radio and television, when accepting their Prizes and/or after having received their Prizes. The winners will be given the opportunity to decline the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Promotional Competition.
All participants are deemed to have read and understood the terms and conditions.
The Promoters are not liable for any defect in the Prizes. All ancillary costs, including but not limited to transport, meals, personal and incidental expenses, insurance, government taxes or other fees applicable, are the responsibility of the winners and/or participants.
All participants and the winners as well as their partners, as the case may be, indemnify the Promoters, their advertising agencies, advisers, nominated agents and suppliers, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this Promotional Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or use of the Prizes).
